Danny Marks is a litigator, business attorney, and advisor who enjoys finding creative solutions to complex problems. He has been recognized for his work in Commercial Litigation, Alternative Dispute Resolution, Employment Law, Construction, and Corporate Law.
Danny’s litigation practice spans commercial and intra-corporate disputes, trade secret theft, restrictive covenant violations, employment and wage disputes, fiduciary duty and fraud claims, workplace torts, workplace violence, construction, and real estate. He also represents clients in government investigations before the Department of Justice, Equal Employment Opportunity Commission, Arizona Civil Rights Division, National Labor Relations Board, Arizona Department of Environmental Quality, Department of Insurance, Registrar of Contractors, and more.
Danny has worked on more than $930M of business transactions, maintaining a corporate practice covering formation, governance, ownership and management disputes, and transactions of all sizes.
Danny received his J.D., graduating early and with distinction, from the University of Nebraska College of Law, where he was published in the Nebraska Law Review Bulletin, earned multiple CALI Awards, competed on the national trial team, and was inducted into the Order of Barristers. He holds a B.A. in History, magna cum laude, from the University of Arizona, and previously clerked for the Honorable Michael J. Brown of the Arizona Court of Appeals.

Litigation
First-chaired a week-long jury trial and prevailed on all claims, obtaining an award of punitive damages, attorneys’ fees, and costs.
Successfully advocated during lengthy oral arguments on complex issues, including motions with approximately $4M at issue.
First-chaired a week-long arbitration for a contract dispute and obtained an award in excess of $585,000.
Secured judgment on the pleadings on a $300,000+ issue, which led to an early, favorable resolution for the client.
Secured dismissal of ADEQ charges that would have eliminated a majority of the client’s revenue.
Obtained sanctions against opposing parties for discovery misconduct and contempt of court.
Successfully defended organizations before the Equal Employment Opportunity Commission, Arizona Civil Rights Division, National Labor Relations Board, Department of Labor, Department of Insurance, and more.
Defeated a Chapter 11 reorganization plan and negotiated an amended plan that was more advantageous to the client.
Obtained dismissal of fraud-based claims raised in Federal Court, as well as dissolution of a temporary restraining order.
Secured many Injunctions Against Workplace Harassment, some of which have prohibited the defendant from possessing weapons.
Resolved a lawsuit alleging breach of contract and fraud related to a $22M transaction for less than 1% of demand.
Successfully argued for judgment as a matter of law on many claims during a week-long jury trial, resulting in more than 60% of claims being dismissed.
Second-chaired multiple jury trials and administrative proceedings, including obtaining judgment on a contract dispute in excess of $750,000.
Prevailed on a Motion to Dismiss a Federal Court case that raised six different employment claims.
Resolved a Federal Court case that asserted seven different claims against the client for only 2.5% of demand.
Authored materials that resulted in the early settlement of the matter for over $700,000.
Secured reversal of a judgment entered in a bankruptcy court adversary proceeding.
Obtained dismissal of an opposing party’s appeal, plus an award of attorneys’ fees and costs.

Have worked on more than $930,000,000 worth of transactions.
Advise and assist businesses with corporate governance issues, ranging from formation to dissolution, annual meetings, buy-sell agreements, shareholder disputes, and takeovers.
Represented the seller of a national company in connection with a complex private equity transaction (over $90M).
Compelled the buyout of a co-owner of three businesses for significantly less than demands.
